According to Pfizer, the case was prosecuted by United States Attorney for the District of New Jersey, John D. Lechleiter, Jr., who handled the case. Pfizer also was part of a multi-state federal prosecution.
The case comes on the heels of a California jury in favor of the defendant, who was sentenced to life in prison.
The defendant, Eli Lilly, was convicted in 2013 after he pleaded guilty to a misdemeanor charge of fraud and money laundering. In a statement, Lilly’s attorney, Matthew K. Lamm, said the case is “a clear response to the federal investigation” in which “they are seeking to find out exactly what happened to the defendant and his family when they were arrested for illegally marketing Viagra, which is a dangerous drug.”
Lamm stated that “we are committed to ensuring that the defendant has no chance of receiving a life sentence” in this case.
In the end, the U. S. District Court for the District of New Jersey found Lilly guilty of conspiracy to defraud and money laundering for its illegal marketing of sildenafil citrate.
According to the company’s statement, the court also found that the defendant had knowledge of all relevant information that Lilly knew about. The company also knew it was selling sildenafil citrate through its website.
The company did not comment on the case’s closing statements. The company appealed to the U. Supreme Court.
